Marietta sits in Cobb County, about 15 miles northwest of Atlanta in a straight line, inside the Atlanta-Sandy Springs-Roswell metro area. [Census QuickFacts](https://www.census.gov/quickfacts/fact/table/mariettacitygeorgia/PST045224) put the city’s population at 63,574 as of July 1, 2025.

Two rulebooks apply. Federal rules under 21 CFR Part 1271 govern human cells and tissues in all 50 states. ## Is Adipose Tissue Banking Legal for Marietta Residents?

## What Georgia House Bill 1275 Requires of Local Providers

HB 1275 (2026 Ga. Laws Act 453) was signed in May 2026 and took effect July 1, 2026. It requires three things of a physician, or of a physician assistant or nurse practitioner acting on lawful designation: signed consent, an advertising notice, and cells from a qualifying facility. The [enrolled bill text](https://www.legis.ga.gov/api/legislation/document/20252026/248639) is public.

Consent must be signed before the therapy, in a language the patient may reasonably be expected to understand. It covers the nature and character of the proposed treatment, the fact that the therapy has not yet been approved by the FDA, and the anticipated results.

The notice must appear in any form of advertisement, in type no smaller than the largest type used for the services offered. It states that the physician or designee “performs one or more human stem cell therapies that have not yet been approved by the FDA.”

Cells must come from a facility registered with the FDA and located in Georgia, another state, or another country, or one certified and accredited by the World Marrow Donor Association, the Association for the Advancement of Blood and Biotherapies, the American Association of Tissue Banks, or another entity the Department of Public Health deems appropriate. A violation may bring discipline from the licensee’s professional board, and nothing more.

## Four Things House Bill 1275 Does Not Do

First, it does not legalize, authorize, approve, or create access to any stem cell therapy. No patient entitlement language appears in the text.

Second, it does not require the facility to sit in Georgia. The introduced bill said Georgia; the enacted text says Georgia, another state, or another country. Third, it does not impose a minimal manipulation standard. That term is defined and then never used again in the operative text. Fourth, the National Marrow Donor Program is not an accepted accreditor. It was removed before passage.
