The patient across from you has usually read something first. He arrives with a printout, a social post, or the memory of a radio spot about using his own fat. The consultation starts from a claim somebody else made.

That changes the task. There is no approved intervention to weigh, so the question is how to describe a field the patient met entirely through advertising. The answer is mostly regulatory.

The first two apply the minimal manipulation and homologous use analysis to named conditions, and erectile dysfunction sits in the same position. The third turns on exosome products rather than 1271.10(a), which matters because exosome offerings are common in men’s health advertising.

## The Consumer Alert a Patient Can Read Without You

FDA maintains a [consumer alert on regenerative medicine products](https://www.fda.gov/vaccines-blood-biologics/consumers-biologics/consumer-alert-regenerative-medicine-products-including-stem-cells-and-exosomes), published in July 2020 and current as of April 2024. Two statements do most of the work. Blood-forming stem cells from cord blood are the only approved stem cell products, and no exosome product is FDA approved.

## The FTC Standard Behind Every Practice Advertisement

FDA is not the only agency reading a urology practice website. The FTC’s [Health Products Compliance Guidance](https://www.ftc.gov/business-guidance/resources/health-products-compliance-guidance), published in December 2022, applies alongside FDA jurisdiction rather than instead of it.

Four points decide most cases. Claims are read for what they imply as well as what they say, so a citation beside a service description can make a claim the copy never states. Every objective health claim needs competent and reliable scientific evidence, meaning evidence the relevant scientific field accepts, held before the advertisement runs. An uncontrolled series substantiates nothing, testimonials count as the advertiser’s own claims, and qualifying disclosures must be clear and conspicuous.

## The State Law Layer, and Why Florida Is the Sharp Case

Federal law is only the first filter. Several states regulate non-FDA-approved stem cell therapy directly, and Florida draws the line that matters most to urology. Its law, enacted as [CS/CS/SB 1768](https://www.flsenate.gov/Session/Bill/2025/1768/BillText/er/HTML) and effective July 1, 2025, permits such therapy only when it is within the physician’s scope of practice and related to orthopedics, wound care, or pain management.
