Detroit sits in Wayne County, and patients there usually start by hunting for the Michigan rule. Several states wrote one. Michigan did not.

The gap is real and worth stating plainly. Federal protection is unchanged, because 21 CFR 1271.20 applies in all 50 states. No state rule forces a warning into an advertisement, so more of the reading falls to the patient.

## Does Michigan Have a Stem Cell Law?

No. A validated full text search of the Michigan Compiled Laws returns no statute on stem cell therapy, advertising, or disclosure. “Regenerative medicine” and “exosome” each return zero results. The only “regenerative” hits are a tax section and MCL 333.12526a, a swimming pool filter requirement.

“Stem cell” returns eleven sections: a constitutional research provision, Strategic Fund and tax credit sections, and the [cord blood bank sections](https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-333-2682) at MCL 333.2681 to 333.2683a, which set up a statewide network of cord blood stem cell banks, effective Jan. 4, 2007.

Cord blood is not adipose. FDA’s [consumer alert](https://www.fda.gov/vaccines-blood-biologics/consumers-biologics/consumer-alert-regenerative-medicine-products-including-stem-cells-and-exosomes) states that the only approved stem cell products are “blood-forming stem cells… derived from umbilical cord blood,” approved for disorders of blood production only.

[Article I, Section 27](https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-Article-I-27) of the Michigan Constitution, “Human embryo and embryonic stem cell research,” was added by initiated law effective Dec. 19, 2008. It permits research and regulates no advertisement.

## What Michigan Law Does Apply to Providers?

Two general provisions carry the weight. [MCL 445.903](https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-445-903), the Michigan Consumer Protection Act, states that “Unfair, unconscionable, or deceptive methods, acts, or practices in the conduct of trade or commerce are unlawful.”

[MCL 333.16221](https://www.legislature.mi.gov/Laws/MCL?objectName=mcl-333-16221) makes “unethical business practices, consisting of… False or misleading advertising” a ground for disciplinary proceedings, at subsection (d)(i). It was last amended by 2026 Act 3, effective Mar. 17, 2026.

## Federal Rules Behind Adipose Tissue Banking in Michigan

Federal law reaches every Michigan provider regardless. [21 CFR Part 1271](https://www.ecfr.gov/current/title-21/chapter-I/subchapter-L/part-1271), titled “Human Cells, Tissues, and Cellular and Tissue-Based Products,” governs human cell and tissue products in all 50 states.

Under [the four criteria](https://www.ecfr.gov/current/title-21/section-1271.10) at 1271.10(a), a product sits solely under section 361 only if it is minimally manipulated and for homologous use only, among other conditions. Criterion two names “labeling, advertising, or other indications of the manufacturer’s objective intent,” so advertising sits inside the regulation.

Anything failing those criteria and not otherwise excepted “will be regulated as a drug, device, and/or biological product” under [section 1271.20](https://www.ecfr.gov/current/title-21/section-1271.20). FDA’s [July 2020 guidance](https://www.fda.gov/regulatory-information/search-fda-guidance-documents/regulatory-considerations-human-cells-tissues-and-cellular-and-tissue-based-products-minimal) considers adipose a structural tissue and states that isolating stromal vascular fraction is “generally considered more than minimally manipulated.”

## Can Detroit Area Residents Bank Adipose Tissue?

Yes, and no Michigan statute restricts or authorizes it. Banking is a preservation decision, not a medical one. Save My Fat is a connector.
