Someone sees a local offer, or hears about a procedure done overseas, and wants a plain yes or no. The rules do not give one. Federal law here works on products, not on cells as a category. A short list of [four criteria](https://www.ecfr.gov/current/title-21/section-1271.10) at 21 CFR 1271.10(a) sorts material into one pathway or another, and anything failing that list and not excepted under 1271.15 “will be regulated as a drug, device, and/or biological product” under [21 CFR 1271.20](https://www.ecfr.gov/current/title-21/section-1271.20). Here is what each layer asks and where its answer comes from. The material is not what the rule targets. Part 1271 of Title 21 covers human cells, tissues, and cellular and tissue-based products, and asks how something was processed and how it will be used. Fail one, and 1271.20 routes it to the drug, device, or biological product pathway. Adipose tissue shows how fast that happens. FDA’s [July 2020 guidance](https://www.fda.gov/regulatory-information/search-fda-guidance-documents/regulatory-considerations-human-cells-tissues-and-cellular-and-tissue-based-products-minimal) treats adipose as structural tissue and calls isolating “stromal vascular fraction” “generally considered more than minimally manipulated.” The same guidance places adipose used for a degenerative, inflammatory, or demyelinating disorder outside homologous use. FDA’s [patient information page](https://www.fda.gov/vaccines-blood-biologics/consumers-biologics/important-patient-and-consumer-information-about-regenerative-medicine-therapies) states that “the fact that a firm has registered with FDA and listed its product does not mean the product is legally marketed.” --- ## Procedures: A State Question With a Federal Ceiling Whether a physician may perform a procedure is largely a state matter, and the state answer cannot move the federal one. No state statute can approve a product, override FDA jurisdiction, or make an unapproved product legal to market. The rule at 1271.20 applies in all fifty states. Nevada put that in writing. The [Nevada statute](https://www.leg.state.nv.us/NRS/NRS-629.html) at NRS 629.350 says “Nothing in NRS 629.300 to 629.390, inclusive, shall be construed to indicate the status of any of the activities authorized pursuant to NRS 629.300 to 629.390, inclusive, as regards federal law.” --- ## Marketing Claims Are Part of the Legal Test Advertising is not a separate topic here. It is one of the criteria. The second criterion at 1271.10(a) turns on intended homologous use “as reflected by the labeling, advertising, or other indications of the manufacturer’s objective intent.” How something is promoted helps decide which pathway it falls into. So the wording of an offer is evidence, not decoration.
